NOTICE OF PUBLIC HEARING APPLICATION NO. 14-SP-04 Notice is hereby given that the CITY COMMISSION of the City of Sarasota, Florida will meet on Monday, July 21, 2014 at 6:00 p.m. in the Commission Chambers, City Hall, 1565 First Street, Sarasota, Florida. Starting at 6:00 p.m. or as soon thereafter as p ossible, the Commission will open the scheduled Public Hearings in the order they appear on the Agenda. The following Resolution will be considered for adoption at the above scheduled meeting: RESOLUTION NO. 14R-2422 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SARASOTA, FLORIDA, AMENDING RESOLUTION NO. 08R-2007 WHICH APPROVED APPLICATION NO. 07-SP-17 THEREBY PERMITTING CONSTRUCTION OF A TEN STORY MIXED USE BUILDING CONTAINING 168 RESIDENTIAL DWELLING UNITS, 10 ,000 SQUARE FEET OF RETAIL SPACE, 21,000 SQUARE FEET OF OFFICE SPACE AND 230 OFF STREET PARKING SPACES ON PROPERTY LOCATED AT 1445 SECOND STREET WITHIN THE DOWNTOWN CORE (DTC) ZONE DISTRICT BY APPROVING SITE PLAN AMENDMENT APPLICATION NO. 14-SP-04 SO AS TO ADD THE ADJACENT PARCEL AT 1401 2ND STREET TO THE SITE PLAN FOR DEVELOPMENT LIMITED TO A MAXIMUM OF 7,410 SQUARE FEET OF GROUND-FLOOR RETAIL OR OFFICE USES, 12 RESIDENTIAL DWELLING UNITS, 9 ACCESSORY GUEST UNITS AND ACCESSORY RESIDENTIAL USES, SUCH AS A POOL, CLUBHOUSE, FITNESS CENTER AND ACCESSORY PARKING, AND THEREBY ALLOWING ONE SINGLE BUILDING TO BE CONSTRUCTED ACROSS BOTH PARCELS; SAID PROPERTY BEING LOCATED WITHIN THE BOUNDARIES OF THE FORMER DOWNTOWN RESIDENTIAL OVERLAY DISTRICT; THE PREVIOUSL Y APPROVED SITE PLAN INCORPORATED ADDITIONAL DWELLING UNIT DENSITY ALLOWED WITHIN THE DOWNTOWN RESIDENTIAL OVERLAY DISTRICT; SETTING FORTH CONDITIONS OF APPROVAL OF SAID SITE PLAN AMENDMENT; PROVIDING FOR READING BY TITLE ONLY; AND PROVIDING FOR AN EFFEC TIVE DATE. Said application is on file in the Department of Neighborhood and Development Services and the Office of the City Auditor and Clerk at City Hall at the above address for public inspection from 8:00 a.m. to 5:00 p.m., Monday through Friday. This is a public hearing; therefore, all interested persons will be entitled to personally testify at the hearing and to submit documents or letters. Persons granted status as an Affected Person by the City Commission will additionally be allowed to present the sworn testimony of other witnesses, relevant exhibits and other documentary evidence and to cross-examine witnesses. In order to qualify as an Affected Person, a person who may be adversely affected by the action of the City Commission must file a Request for Affected Person Status form with the Office of the City Auditor and Clerk at least five (5) complete working days prior to the quasi-jud icial hearing. If a person decides to appeal any decision made by the board, agency, or commission with respect to any matter considered at such meeting or hearing, he or she will need a record of the proceedings, and, for such purpose, he or she may need to ensure tha t a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based. Reasonable auxiliary aids and services will be made available to qualified disabled individuals to the extent that no undue financial or administrative burden results.
